Jeffrey R. Kuester and Michael A. Cicero Update “Intellectual Property Litigation” Chapter of the 2024 Edition of Georgia Business Litigation

Jeffrey R. Kuester and Michael A. Cicero further updated their chapter titled “Intellectual Property Litigation” for the 2024 Edition of Georgia Business Litigation, published by ALM Media Properties, LLC on August 1. The chapter debuted in the 2016 Edition of this publication and underwent updates for 2017, 2018, 2020, and 2022 Editions. The 210-page chapter includes updates discussing 2021-23 decisions from Georgia federal and state courts addressing trademarks and copyrights, as well as recent U.S. Supreme Court and Eleventh Circuit decisions on those subjects. The updates include new text written by Mr. Cicero discussing standing to assert Lanham Act trademark claims; reverse trademark confusion; personal jurisdiction and venue in trademark litigation; newly-created expungement and reexamination proceedings before the Trademark Trial and Appeal Board; and proceedings before the newly-created Copyright Claims Board.
