"Federal Circuit Expands Generics – Including ZERO for Soft Drinks," IAM Weekly International Reports

in the July 2018 issue of IAM Weekly International Reports, Linda Yang discusses TTAB's decision related to whether ZERO was a generic name and the subsequent Federal Circuit ruling to vacate and remand TTAB's decision. 

According to the court, “a term is generic if the relevant public understands the term to refer to part of the claimed genus of goods or services, even if the public does not understand the term to refer to the broad genus as a whole”.
