Landlords Beware: Accepting Partial Payments Could Waive a Landlord's Right to Collect

In a new GA Court of Appeals decision, the court sided with a tenant, finding that by the Landlord accepting reduced and irregular payments for an extended period a quasi-new agreement was created. In light of this ruling, Landlords who accept partial rent payment or allow a tenant to skip a rental payment should immediately inform the tenant in writing that the landlord intends to enforce the exact terms of the lease as written going forward to ensure no new agreement/lease is created and that the Landlord does not waive its rights to collect payment of rent in full.
