The federal Superfund law or "CERCLA" was enacted in 1980 to clean up hazardous-waste sites. After 40 years, the cleanup goes on, both at the sites and in the courts. Questions of interpretation of the statute continue to arise.
One significant case in 2020 from a federal district court in Minnesota addressed the intersection of CERCLA with state indemnity law. A broadly worded indemnification provision in a deed was held to be ambiguous on whether it covered costs of environmental cleanup. Analysis of liability under Superfund will often involve questions of state law of property and contract.
